Disgraced former cyclist Bernhard Kohl has lost a court case over claims that a top doctor knew of his doping.
A Korneuburg court yesterday (Thurs) banned the 26-year-old from making any further claims that former Gerolsteiner cycling team physician Mark Schmidt had been aware Kohl was blood doping during the 2008 Tour de France in which he finished third.
Kohl – who retired from professional cycling last year after being banned for two years – had an appeal against the ruling immediately dismissed by the High Regional Court of Vienna.
The case had come to court after legal action by German Schmidt, now team doctor at professional cycling team Milram.
Kohl claimed in interviews with Austrian newspaper Kurier that Schmidt received a blood centrifuge from his former manager Stefan Matschiner during the 2008 Tour de France.
The Lower Austrian – who pledged to cooperate with doping investigators – also claimed Schmidt had told him it was "logical" that cyclists had to dope if they wanted to be successful.
